1. Scope and Contracting Party

These Terms of Use govern the use of the “parX” app and website (hereinafter “parX” or the “Service”). The provider is:

By registering a user account or using parX, you accept these Terms of Use. If you do not agree to them, you may not use parX.

2. Description of Services

parX is an app for theme park fans. Among other things, it allows you to:

Check in at theme parks, attractions, and other locations

·

Connect with friends, browse an activity feed, and send direct messages

·

Take part in public chats about individual parks and attractions

·

View wait times provided by third parties (including queue-times.com and ThemeParks.wiki)

·

Use gamification features such as achievements, experience points (XP), levels, and a “mayor” feature for frequently visited locations

parX is provided free of charge. Optional paid add-on features (“Supporter”) can be purchased via in-app purchases; details are displayed before each purchase.

3. Registration and User Account

Using parX requires a minimum age of 16 years.

You must provide truthful information when registering. A user account is not transferable.

·

Access credentials (password, access to linked third-party accounts) must be kept confidential. You are responsible for activities carried out using your access credentials, unless you are not responsible for their misuse.

Registration can be done via email and password or through the third-party providers Google, Apple, or Facebook. If you sign up or link your account via Facebook, the terms of use and data policies of Meta Platforms, Inc. additionally apply.

4. Obligations When Using the Service

When using parX, you agree in particular not to:

post unlawful, offensive, discriminatory, violence-glorifying, or otherwise objectionable content in chats, comments, check-in notes, or your profile

·

make false check-ins or otherwise manipulate the “mayor” feature, leaderboards, or other gamification elements

·

harass, threaten, or stalk other users

·

use automated means (bots, scrapers) to access parX or extract data from the app

·

infringe on the rights of third parties, in particular copyright, personal rights, and trademark rights

You can report violations using the reporting and blocking feature built into the app.

5. User-Generated Content

You retain ownership of content you publish via parX (e.g. photos, check-in notes, chat messages, profile information). However, you grant us a simple, non-exclusive license, limited in time and scope to the operation of parX, to display this content within the app and website (e.g. in the activity feed, on your profile, or in chats) to the extent necessary for the respective feature. This license ends when the respective content or your account is deleted.

You represent that you hold the necessary rights to the content you publish and that its publication does not infringe the rights of any third party.

6. Friends Feature and Linking Third-Party Accounts

parX lets you find friends you already know through other channels — for example by matching your phone contacts or by connecting your Facebook account. These features are optional and require your explicit consent.

When you connect Facebook, we match your Facebook friends who have also connected parX with Facebook against existing parX accounts. Only the Facebook ID and public display name are processed for this purpose. When matching your phone contacts, your address book never leaves your device — only one-way checksums (hashes) of phone numbers are transmitted and compared against the (likewise hashed) numbers of other parX users.

You can revoke the Facebook connection and discoverability via your phone number at any time in the app settings. Details on data processing can be found in our Privacy Policy.

7. Suspension, Reporting, and Termination

You can delete your user account at any time via the app settings. In the event of serious or repeated violations of these Terms of Use, we reserve the right to remove content and to temporarily suspend or permanently delete user accounts.

To report violations and users, please use the corresponding feature within the app.

8. Availability and Changes to the Service

We strive to keep parX available as continuously as possible but do not guarantee uninterrupted availability. We reserve the right to perform maintenance, further development, and changes to the scope of features. We pass on data provided by third parties (e.g. wait times) unchanged and without any guarantee of its accuracy or timeliness.

9. Liability

We are liable without limitation for intent and gross negligence, and in accordance with the German Product Liability Act. In cases of slight negligence, we are only liable for the breach of a material contractual obligation (cardinal obligation), limited to the foreseeable damage typical for this type of contract.

We assume no responsibility for content published by users (e.g. chat messages, check-in notes, photos); the publishing user is solely responsible for it.

10. Changes to These Terms of Use

We reserve the right to amend these Terms of Use as needed, for example due to changes in the scope of features or the legal situation. We will inform registered users of material changes by email. The current version is always available in the app and on this page.

11. Final Provisions

These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
